Can Foreigners Buy Property in Seminyak

No, not in the way a freehold buyer from most countries would expect. Hak Milik Stays Off Limits for Foreigners

Citizenship decides who may hold Hak Milik, Indonesia's full freehold title. An Indonesian passport unlocks it under the UUPA, the country's Basic Agrarian Law, at Articles 9 and 21 specifically; any other passport does not, whatever a PT PMA structure is layered on top.

Nothing about a Seminyak address changes that baseline. Whatever a listing calls "freehold," a foreign buyer is never the one holding Hak Milik directly, whatever paperwork gets drawn up around it.

Three Structures That Actually Reach a Buyer

Hak Sewa leasehold is the route most foreign buyers actually use: a private, notarised contract to occupy land someone else holds as Hak Milik, open to any nationality without a visa or a company behind it.

Hak Pakai works differently. It requires a valid KITAS or KITAP, and in Bali Province the landed house it attaches to must be priced at Rp 5 billion or more, per Permen ATR/BPN 18/2021. A Nominee Still Fails, Every Time

Registering the certificate to an Indonesian citizen while a foreigner actually pays for and controls the property, the nominee route some sellers still float, has never held up. Getting the Structure Right Before You Sign
